- The applicant worked with a BPO, founded by the main accused in the case. This BPO used the name of Microsoft and thereby cheated American citizens into sharing their confidential data.
- They provided access to their confidential data on believing that their computer was affected by a virus. This was done using a software called TeamViewer. Hence, they received US dollars by cheating the American citizens.

- The applicant’s counsel argued that the applicant was a mere employee who didn’t know that the BPO wasn’t rightly authorised to use the software. Also, he had already resigned in August 2015.
